By accessing and using Peddl ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

Peddl is an online marketplace platform that connects buyers with independent creators and sellers. We provide the technology and infrastructure to facilitate transactions between users, but we are not directly involved in the transactions themselves.

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. User Types and Fees

Customers: Free to browse and purchase products. No monthly fees.

Creators/Sellers: $10/month or $100/year subscription. Free 14-day trial available. Subject to 10% commission on all sales.

Event Coordinators: $10 per event fee. No monthly subscription required.

5. Seller Obligations

If you sell products or services on Peddl, you agree to:

  • Provide accurate descriptions of your products/services
  • Honor all sales and provide products as described
  • Comply with all applicable laws and regulations
  • Handle customer service inquiries professionally
  • Ship items in a timely manner or provide services as agreed
  • Pay all applicable fees and commissions

6. Buyer Obligations

If you purchase products or services on Peddl, you agree to:

  • Provide accurate payment and shipping information
  • Pay for all items you purchase
  • Communicate with sellers in a respectful manner
  • Only file disputes for legitimate reasons

7. Prohibited Activities

You may not use the Platform to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Sell counterfeit, stolen, or illegal items
  • Engage in fraudulent activities
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Interfere with the Platform's operation
  • Attempt to bypass security measures

8. Payment and Fees

All payments are processed securely through Stripe. You agree to pay all applicable fees and understand that:

  • Subscription fees are non-refundable
  • Commissions are automatically deducted from sales
  • Payment processing fees are included in our commission rate
  • You are responsible for all applicable taxes

9. Intellectual Property

You retain ownership of content you post on Peddl, but grant us a license to use, display, and distribute that content on the Platform. You represent that you have all necessary rights to any content you post.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms of Service or for any other reason we deem appropriate. You may also terminate your account at any time.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEDDL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.

13. Dispute Resolution

Any disputes arising from these Terms of Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes. Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.
